Quotations
Our offers remain valid for a maximum of one month unless otherwise agreed. All published prices do not include surcharges (fuel surcharge, extra order cost, return contribution,...).
Delivery conditions
The delivery period is indicated by way of information. The parties agree that the delivery times of the goods are indicative and non-binding. The seller shall not be liable in the event of late delivery, unless if the late delivery is due solely to an intentional, fraudulent or grossly negligent fault on the part of the seller. In case we are unable to meet the total demand of the goods ordered for any reason, we have the right to divide the available stock or make partial deliveries. We reserve the right to refuse an order subject to valid reasons of any kind and, in any case, we have the right to refuse any order of excessive quantities. Unless otherwise agreed, the goods are transported at our risk and expense. The transfer of ownership only takes place after full payment of the agreed price. However, the customer bears the risk as of delivery. We are only liable with regard to the use and resulting consequences of the goods themselves, whether or not in combination with other goods in case of the customer's own intentional or fraudulent fault, in which case the liability shall be limited to the damage directly suffered by the customer, excluding immaterial, indirect or consequential damage, such as, but not limited to, loss of profit, loss of turnover, loss of income, missed opportunities, loss of clientele or any claims from third parties (including the customers of the customer) and always limited to the amount covered by the insurance. If the goods have been handled and/or processed by the customer or a third party in any way, any warranty shall lapse.
Terms of payment
Our representatives are not authorised to receive payments or advances. Payments are made only validly to our bank account.
Our invoices are payable for regular customers within 14 days of the invoice date. New customers pay in cash until they are recognised by us as regular customers.
Late payment shall automatically and without notice of default give rise to a compensation of 10% with a minimum of 50 euros, above and beyond a default interest of 1% per month, whereby each started month shall be considered full. In the case of authorised or agreed instalment payments, if payment is not made on time, the balance shall be immediately due and payable in full. In the event of experienced payment difficulties, we also reserve the right to make any subsequent delivery cash on delivery and/or even suspend it.
Returns and complaints
We have the right to credit goods with an expiry date of less than one year, which are taken back after written approval, at a lower price than originally invoiced.
Goods that have expired will neither be taken back nor credited. Goods to be stored at a temperature below 8°C will not be taken back, unless they are the subject of a proven faulty delivery and provided the goods have been stored without interruption of the cold chain, according to the instructions on the packaging.
Goods ordered and delivered by us specifically at the customer's request will not be taken back. Articles purchased under the cascade arrangement will not be taken back. taken back.
The customer is obliged to examine upon delivery whether the goods comply with the agreement. A return due to an error by the customer must be requested at the latest within 4 working days following delivery. This is possible via the ‘Request return’ button in the Delivery Overview on our web portal. A fee will be invoiced for each return request.
Complaints about non-conformity of delivery or about quality issues can be reported via the ‘Report complaint’ button in the Delivery Overview on our web portal. If the complaint concerns a non-conformity of delivery, it must also be reported within 4 working days of delivery.
Only with our written consent (return slip), the customer may return the goods to be returned or give them to our driver. Only in their original and unopened packaging will those goods be accepted. If complaints are found to be admissible and justified, our obligation is limited to replacing or repairing the defective or damaged goods, and the damage may not exceed the cost price of the goods sold. No other damage by the buyer or a third party shall be eligible for compensation.
The customer should be aware that the trade in and application of the delivered goods requires a high degree of guidance and expertise. The customer is obliged to pass on all regulations, instructions, advice and manuals he receives to further customers of his. The customer shall indemnify the company against all claims of third parties arising from the improper use or from a use not in accordance with the rules of the art by the buyer or any other person, for whom the customer is or can be held liable or to whom the customer should have passed on the instructions. Similarly, the customer shall ensure that the cascading arrangement is always applied according to the rules of the European Regulation 2019/6/EC and this on his own responsibility.
Entrusting an order to us implies the customer's agreement to the above terms and conditions. Deviation from these terms and conditions can only be made in writing.
Warranty
Our appliances are guaranteed for 1 year against manufacturing defects. Only after analysis by our technical department can we determine whether the necessary repair falls within the warranty. Analysis costs, working hours and transport are at the customer's expense.
Disputes
Belgian law applies to all our sales. All disputes or disagreements between the parties regarding the existence, interpretation or performance of our sales are within the exclusive jurisdiction of the Courts of the district of Hasselt.
